SD Signings Terms / Approval of Services

In regards to this agreement, the signer(s) and/or appointment coordinator(s), collectively referred to as “S&C”, acknowledge that “SD Signings” includes all parties involved in the transaction, including notaries, representatives, contractors, employees, and any services utilized for the work. Coordinators will provide notary prerequisites and pricing information to signers and ensure that all terms listed below are met. S&C agrees to all terms and authorizes the notary public and SD Signings to perform work on their behalf.

S&C UNDERSTAND ADHERE TO STATE AND FEDERAL LAW

All signers and coordinators, referred to as “S&C” in this agreement, are expected to comply with state and federal laws. S&C acknowledges that SD Signings notaries will conduct themselves lawfully in accordance with California law regarding notarial acts. The following guidelines and terms are the responsibilities of S&C. Please ensure that all notary prerequisites are met in advance.

S&C UNDERSTAND ROLE OF NOTARY:

  • If a signer does not demonstrate full understanding of the documents, lacks capacity, cannot communicate, or is unwilling to sign, the notary will cancel services onsite.
  • The notary will only identify a signer based on the identification provided by S&C. S&C must provide identification that matches the name on the documents for the notary to proceed. If the identification includes additional names, it is acceptable.
  • The notary cannot assist in completing documents, act as an agency representative, or provide legal or professional advice.

S&C UNDERSTAND PAYMENT RESPONSIBILITY:

S&C acknowledges that payment is their responsibility and agrees to compensate SD Signings and/or any of its affiliates, contractors, or representatives for services rendered on S&C’s behalf. S&C also agrees to pay for any additional services and fees required to complete the transaction, such as rush delivery fees. If an escrow company or any affiliated party is handling the transaction, S&C consents to the escrow or affiliated party making payment directly to SD Signings and/or the designated notary until the transaction’s closure. In the event that the escrow or affiliated parties fail to make payment for the services, S&C understands that they will be liable for payment to SD Signings and/or the notary for the provided services.

S&C UNDERSTAND PRIVACY AND ALLOW RELEASE OF INFORMATION

S&C understands that our website collects and stores information from forms, uploads, and your computer so that we may respond to your inquiry. As most transactions involve the use and disclosure of sensitive identifying information, S&C agrees to allow SD Signings to forward this information to the parties involved in the transaction, such as the escrow, bank, legal representatives, or contracted notaries. S&C further release liability for any breach of information within the transaction.

S&C UNDERSTAND RELEASE OF LIABILITY CONCERNING INJURY, HEALTH, & SAFETY

S&C hereby release SD Signings and its affiliates from any liability related to accidental injury. S&C acknowledge that during the COVID-19 pandemic, there are additional safety risks to consider when meeting people in person and understand these risks. S&C will take appropriate precautions, including maintaining a safe distance, wearing a mask, and washing/sanitizing their hands before and after the appointment, to ensure everyone’s protection.

S&C UNDERSTAND RESPONSIBILITY TO TRANSACTION

S&C acknowledges their responsibility for the transaction and have reviewed the documents to ensure they are complete and ready for notarization. S&C understands that any legal or professional advice should be sought from the appropriate counsel. S&C has read and understood the prerequisites outlined by SD Signings on sdsignings.com and the roles of the Notary Public instituted by the State of California. S&C will hold the Notary Public and SD Signings harmless, accepting all liability for the signed documents. S&C affirms that they have not misrepresented any information or their intentions to SD Signings and that the signers willfully intend to sign the documents before the notary. Additionally, S&C affirms that the statements within the documents requiring notarization are true and correct.

www.sdsignings.com. The SD Signings; website is a notary information and services site. By using the SD Signings website, you consent to the data practices described in this statement.
