SD Signings Terms / Approval of Services

Concerning this agreement, I/We, the signer(s) and/or appointment coordinator(s), are hereby called “S&C”. Concerning this agreement, S&C understands that “SD Signings” includes all parties affiliated with SD Signings concerning this transaction, including notaries, representatives, contractors, employees, and/or services that have been used for the purpose of work with. Coordinators will further forward notary prerequisite and pricing information to the signers and ensure all below terms are met. 



All Signers and Coordinators, called “S&C” within this agreement, will act in accordance with state and federal law. S&C understand that SD Signings notaries will act lawfully in accordance with California law concerning notarial acts. The following guidelines and terms are the responsibilities of S&C. Please ensure all notary prerequisites are met in advance.


  • A notary will cancel services onsite if a signer does not show full understanding of the documents, lacking capacity, unable to communicate, and/or is unwilling to sign.
  • A notary will only identify a signer according to the identification provided. S&C must provide identification that matches name on the documents for notary to reflect such. If the identification indicates more name, this is ok.
  • A notary cannot assist in completing documents, speak as an agency representative, or provide legal/professional advice.


S&C understands payment is responsibility of S&C and agree to pay SD Signings and/or any of its affiliates, contractors, or representatives to conduct services on S&C’s behalf. S&C further agree to pay for any extra services and fees that may arise (rush delivery, etc) to fulfill the processing of my transaction. If this transaction is being handled through an escrow company or affiliated party, S&C agrees to allow the escrow or other party to pay SD Signings and/or the designated notary directly through the close of this transaction. If escrow or affiliated parties fail to pay for the services, S&C understand that S&C will be responsible for payment to SD Signings and/or the notary for the services provided.


S&C understand that our site collects and stores information from forms/uploads/your computer so that we may respond to you when we see it. Most transactions include the use and disclosure of sensitive identifying information. S&C agree to allow SD Signings to forward this information to the parties involved within the transaction (Escrow, bank, legal representatives, contracted notaries, etc). S&C further release liability of any breach of the information within the transaction.


S&C release liability concerning accidental injury.  S&C understand that during the COVID-19 pandemic there are additional safety risks to consider when meeting people in person. S&C understand the risks. S&C release SD Signings or its affiliates of all liability concerning accidental injury and/or COVID-19. S&C will further be mindful of distance, wearing a mask, and washing/sanitizing my hands before and after the appointment for everyone’s protection. 


S&C recognize responsibility to the transaction. S&C have reviewed that documents are complete and ready for notary. S&C understand any need for legal or professional advice should be directed to the appropriate legal and/or professional counsel. S&C have read SD Signings prerequisites at S&C understand the notary roles instituted by the State of California. S&C hold the Notary Public and SD Signings harmless, accepting all liability for the documents being signed. S&C have not misrepresented truthfulness or S&C’s intentions to SD Signings. S&C affirms signers intend to willfully sign the documents before the notary. S&C further affirms the statements within the documents requiring notarization to be true and correct.

Online Privacy Policy
Protecting your private information is our priority. This Statement of Privacy applies to and SD Signings and governs data collection and usage. For the purposes of this Privacy Policy, unless otherwise noted, all references to SD Signings; include The SD Signings; website is a notary information and services site. By using the SD Signings website, you consent to the data practices described in this statement.

Collection of your Personal Information
We do not collect any personal information about you unless you voluntarily provide it to us. However, you may be required to provide certain personal information to us when you elect to use certain products or services available on the Site. SD Signings docs not sell, rent or lease its customer lists to third parties.
SD Signings may share data with trusted partners to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to SD Signings, and they are required to maintain the confidentiality of your information.
SD Signings may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on SD Signings or the site; (b) protect and defend the rights or property of SD Signings; and/or (c) act under exigent circumstances to protect the personal safety of users of SD Signings, or the public.

Automatically Collected Information
Information about your computer hardware and software may be automatically collected by SD Signings. This information can include: your IP address, browser type, domain names, access times and referring website addresses. This information is used for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the SD Signings website.

Right to Deletion 
Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will:

  • Delete your personal information from our records; and 
  • Direct any service providers to delete your personal information from their records. 

Please note that we may not be able to comply with requests to delete your personal information if it is necessary to: 

  • Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us; 
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity; 
  • Debug to identify and repair errors that impair existing intended functionality; exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;

Children Under Thirteen 
SD Signings docs not knowingly collect personally identifiable information from children under the age of thirteen. If you are under the age of thirteen, you must ask your parent or guardian for permission to use this website. 

E-mail Communications 
From time to time, SD Signings may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. In order to improve our Services, we may receive a notification when you open an email from SD Signings or click on a link therein. 

If you would like to stop receiving marketing or promotional communications via email from SD Signings, you may opt out of such communications by emailing us.
